Terms of Service

These Terms of Service ("Terms") govern your use of upscalepop.com and its API (the "Service"), operated by SDN Bros (the "Operator"). By uploading an image, creating a job, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service enlarges and enhances images you upload, using both deterministic resizing and AI-based enhancement. The Service is offered as a beta and may be changed, interrupted, or discontinued at any time without notice.
2. Your content and your responsibility
- You retain all rights to images you upload. You grant the Operator only the limited right to process, store, and return them to you as part of operating the Service.
- You are solely responsible for the images you upload and for the outputs you generate, including how you use and distribute them.
- You represent that you own the uploaded images or have all rights and permissions needed to upload and process them.
3. Acceptable use
You must not use the Service to upload or process:
- content that is unlawful in your jurisdiction or the Operator's;
- any sexual content involving minors, or any content that sexualizes minors — the Operator will report such material to the relevant authorities;
- images of identifiable people without a lawful basis, or in any way intended to harass, defame, deceive, or create non-consensual intimate imagery;
- content that infringes another person's copyright, trademark, or other rights.
The Operator may remove content and block access at its sole discretion, with or without notice, including for suspected violations of this section.
4. AI output disclaimer
AI enhancement is a statistical reconstruction. Outputs may contain artifacts, inaccuracies, or details that differ from the original image, and identical inputs may produce different outputs over time. Outputs are provided for your evaluation; you are responsible for reviewing them before any use. The Service is not suitable for forensic, evidentiary, medical, identification, or other accuracy-critical purposes.
5. Storage and privacy
Uploaded images and generated outputs are stored only to operate the Service and are automatically deleted after a retention period (currently 30 days). Your images are not used to train AI models. Anonymous sessions are isolated per browser; treat download links as private to you.
6. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. THE OPERATOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT WILL NOT BE LOST.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE OPERATOR'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) TEN US DOLLARS (US$10). Some jurisdictions do not allow certain limitations; in those jurisdictions, liability is limited to the maximum extent permitted by law.
8. Indemnification
You agree to defend, indemnify, and hold harmless the Operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from the images you upload, the outputs you generate or distribute, or your violation of these Terms or of any third party's rights.
9. Changes
The Operator may update these Terms at any time by posting a revised version at this address. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
10. General
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms are governed by the laws of the jurisdiction in which the Operator is established, without regard to conflict of law rules.
